TERMS and CONDITIONS

NOTE: Beyond Dracula Travel (referred to in the agreement as ‘we’, ‘us’ or ‘our’) is a destination management company (DMC)/ tour operator / event organiser / travel agent and does not own, manage, control or operate any aircraft, ground transportation, hotel, resort, cruise ship, restaurant, excursions or other suppliers associated with the assembly of your package.

Whilst we endeavor to ensure that the information on this Website is correct, no warranty, express or implied, is given as to its accuracy and Beyond Dracula Travel does not accept any liability for error or omission.

CONSENT TO TERMS AND CONDITIONS: Please read these Terms and Conditions carefully as they apply to your use of this Internet Site (Website). By using this Website you agree to be bound by these Terms and Conditions. Booking any of the travel products and services we provide is also considered an understanding and acceptance of the Terms and Conditions.

We may revise these Terms and Conditions from time to time by updating this posting. The revised terms will take effect when they are posted. Please check the Website regularly for the latest version of the Terms and Conditions.

BOOKING AND CANCELLATION POLICY*:

In order to book the tour, we kindly ask for a 20% advance payment upfront. This payment is refundable up to 60 days before your arrival. Paying the deposit implies you agree to our terms and conditions, therefore please have a careful read beforehand.

The remaining 80% is to be paid no later than 30 days prior to your arrival.

If you would like to modify or cancel your booking, as well as if you have any complaints or questions of any kind, please contact us via email.

*For groups larger than 5 members, special booking and cancellation policies apply. Please contact us for further information.

No Refund For Unused Arrangements: As our prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while the tour is in progress, there is no refund for the unused portion. Some tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed or the tour canceled.

TRAVEL INSURANCE: Travel insurance is NOT included in the tour price. We strongly recommend that you arrange your own travel insurance to cover against illness, injury, loss/damage to personal belongings.

CURRENCY: All rates are quoted in EURO, although you can pay in USD, GBP or RON. The parity that we consider is the one provided by The National Romanian Bank (BNR) from the last business day before the date that appears on your invoice; the exchange rate and date will be clearly stated on the final invoice.

When you want to pay in different currencies, please specify this in your communication with us.

TRAVEL DOCUMENTS: We can assist and inform you on matters such as required documentation. To the best of our ability, we can give support with providing answers and information pertaining to immigration, customs and health requirements specific to your country. However, it is your responsibility to obtain information and to have in your possession all the required documentation to travel, (such as passports, visa, criminal record checks where applicable etc.) required by the relevant governmental authorities. Failure to have proper travel documents will result in denied boarding and automatic cancellation of your reservation without refund.

LIMITATION OF RESPONSIBILITY AND DISCLOSURE: Beyond Dracula Travel is not the source or supplier of the travel services requested, and acts solely as an agent for disclosed principal supplier hotels, bus companies, ground transportation, and other independent contractors providing accommodations, transportation, and/or other services. Each of these companies is an independent entity with its own management, and is not subject to our control.

Because we act as an agent and do not have the right to control the operations of such independent operators and suppliers, you agree Beyond Dracula Travel is not liable for any personal injury or property damage which may arise out of these services.

Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of our control, and we will not assume any responsibility for any air and/or ground schedule changes.

FORCE MAJEURE: “Force Majeure” means, in relation to Beyond Dracula Travel, any circumstances beyond the reasonable control of Beyond Dracula Travel, including, but without limitation: acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences.

We will not be liable, by reason of delay in performance, or by non-performance, of any of our obligations hereunder to the extent that they occur due to any Force Majeure.

If Beyond Dracula Travel, and/or any of its travel suppliers, are affected by Force Majeure, they can vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund shall remain in our discretion, although we shall use our reasonable efforts to reimburse you where possible. However, we shall be entitled to deduct from any refund recoverable the actual and potential costs incurred up to that moment.

NO COPYING OR EDITING: No material from this Website may be modified, copied, reproduced, republished, downloaded, sold or distributed in any way, without our prior written consent. Unauthorized use of any such material is prohibited.

PRIVACY POLICY: Because we value our guests, we believe that strong electronic privacy is crucial. We will not release your personal data to anyone else, except if you provide your consent or if it is disclosed for the purposes for which you made it available to us.

The only contact details gathered are those which customers voluntarily submit – on enquiry forms, survey forms, over the telephone, by using our website and/or in email messages.
Comments and customer contact details are published on the site’s feedback page only with customers’ written consent.

Any requests to unsubscribe from mailing lists or remove personal data from our databases should be submitted by email. Email newsletter subscribers are able to unsubscribe themselves from mailing lists by clicking on the link at the foot of all email newsletters.


WHO WE SHARE YOUR INFORMATION WITH:
 We do not disclose any information about customer bookings to anyone except in the following circumstances:
• Accommodation suppliers
• Legal obligations: We may be required by law to disclose information against someone whose activities could cause harm to others or in cases of customer fraud.

FINAL PROVISIONS: These Terms and Conditions constitute the entire Agreement between the Customer and Beyond Dracula Travel and are governed by the laws of Romania.

The sale of travel packages will be made in accordance with the hereby agreement and in compliance with the provisions of Government Ordinance no. 107/1999 on the marketing of travel packages, approved with amendments and completions by Law no. 631/2001, Order no. 516/2005 of 12/04/2005 published in the Official Gazette, Part I no. 334 of 20/04/2005 with subsequent amendments.

For any possible debates or questions not covered by this contract, the laws of Romania shall have effect. The relevant documents needed for its operation are enclosed below.
